In 1934, WWI Veterans erected a monument to honor their comrades who had died in battle. The ACLU now wants to tear it down, and all public memorials like it, because of its religious imagery. The land was originally public land. Congress enacted a series of laws which culminated in a land exchange that transferred its ownership from the Parks Service to the VFW. This means the cross is now on privately held land...land owned by the VFW.
UPDATE: The Supreme Court released its decision today in a 5-4 vote. So as of now it can stay.
